Rule 28
Food industry license
(1) A person who wants to produce or process food items mentioned in rule 24 must obtain the recommendation of the Department of Food Technology and Quality Control before applying to the Department of Industry to set up an industry.
(2) A person who wants to get a recommendation according to sub-rule (1) should prepare a plan and submit an application to the Department of Food Technology and Quality Control in relation to the industry he wants to establish:-
(a) Type of Industry,
(b) Machinery required for industry,
(c) Technical Sheep,
(d) Cleaning arrangements,
(e) Type and source of raw materials.
(3) If the application under sub-rule (2) is received, the Food Technology and Quality Control Department will modify the proposed food industry plan according to the need and make a recommendation to allow the establishment of the food industry.
(4) A person who has obtained permission to establish a food industry, after establishing the industry, before starting the production of food items, he must obtain a license as per schedule-14 from the customs department as follows:-
(a) Two hundred rupees for industries with authorized capital up to five lakh rupees.
(b) five hundred rupees for industries with authorized capital up to ten lakh rupees.
(c) One thousand rupees for industries having authorized capital up to twenty lakh rupees (d) One thousand five hundred rupees for industries with an authorized capital of up to one crore rupees.
(e) Two thousand rupees for industries with an authorized capital of up to three crore rupees.
(f) Three thousand rupees for industries with an authorized capital of up to ten crore rupees.
(g) Any amount of authorized capital exceeding ten million rupees, four thousand rupees.
(5) The food industries that have been established before the commencement of this rule shall disclose the details as per sub-rule (2) and apply to the Department of Food Technology and Quality Control and obtain a license as per Schedule-14, paying a fee of twenty rupees.
(6) The license according to sub-rules (4) and (5) shall be kept at the industrial site so that the authorized person can show it when required.
